Does Primary Residence Effect Filing Status?

Hello All,

Big newbie here but the new Hubs and I are confused on how to handle our taxes and we're hoping you all can lend some wisdom.  

We were married this past June, and even though we live together our "primary" residences aren't the same. Both of our names are on our rental lease, but I'm registered and licensed in Maryland while he's still registered and licensed at his parents home in Massachusetts. Can we still file our taxes jointly? Or does he have to match up his primary residence with mine?

Yes you can still file jointly. Google 'irs pub 17' for a lot of useful information.

Federal - should be no issue filing jointly State & City - you may want to get professional help to deal with because you may have to send documentation to the states to show that you no longer residents there even though your licensed there so that you don't have to pay taxes there. When you say registered & licensed I'm assuming you mean your vehicles are registered in different states and so are your driver's license. If I am correct on that then you really need to get licenses for the state you are now residing in and transfer plates too. Most states require that within 60 day of establishing a residence in that state you must transfer your vehicle/license information to that state. Also depending on what state you are living in, if your insurance is still in your prior state, it may not meet the requirements of the new state you are living in. Depending on where you are living, insurance & vehicle costs may be a lot less for your husband in your new staets then in Mass because their stuff is crazy expensive.

The other ladies provided some great advice. I've been doing taxes for the past 6 years, so no your primary residence doesn't effect your filing status.  When you file your taxes, there will be a question (if you are doing yourself) if you were a resident of the specific state? The answer will be yes for your current rental address, then if will ask how long you were a resident of that state. Full year, half time, etc. It will ask for specific dates to include as well. That way it will populate for the 2nd state to be filed for the state taxes as well. If you have any other questions, irs.gov under Pub 17 has all the answers you need for taxes.
