Issue with old cell phone acct in collection...WWYD?

Long story short: I had a Sprint account in 2006 while in college. I was leaving the country & the contract was going to run out in November 2006. My friend was in need of a phone to make ride arrangements & such. I gave it to her thinking that the contract would end while I was away no problem. I got a new Sprint phone and account in 2007 when I came back.

Fast forward, I get a collection notice because the original account went delinquent. Told them what happened & they said that they continued the contract on a month-to-month basis in my name, without my consent. They said since it was in my name, it was my responsibility. Was too broke to pay, told them to back off.

Didn't think anything of it. Until I got a phone call today about it again. Apparently the account went delinquent in 2008. I was just going to let it sit on my credit report for the 7 years (which I thought was coming up in another year or so) but if the 2008 date is right, that would be 2015 & I don't want it on there that long.

Would you try to get the money from the person you gave it to? Would you pay it? Would you negotiate for a lower-than-full amount? Thanks ladies!

I would negotiate a lower amount.  First, this is standard practice, when a contract is over, the plan always continues month to month, it was your responsibility to call and cancel the cell plan.  The benefit of NOT being in a contract is that you can cancel without being charged an early termination fee (ranging from $200-$400 depending on the carrier). 

I would not ask the friend for the money, this is a debt from 4-5 years ago, also you knew about the debt previously and forgot about it.  I could see possibly asking for some money when you first told them to "back off" but this is years down the road. 

Do you have a lump sum to pay them, I normally try to negotiate for 50% and offer a lump sum.  I'm not sure, I've heard conflicting information, but any activity on that account might start your 7 years over again (but at least it would be paid).  I would pay it, they provided a service and deserve to be paid for that service, if they agree to a lesser amount then that's their decision, but I don't think it's right to stiff them just because.

I talked to her at the time and she was as broke as me. I was young and naive. I knew absolutely nothing about credit, scores, or reports.

I've heard the same conflicting information, which is why I was wondering what to do.

I'd certainly try to negotiate.  But I wonder exactly what your contract said...I don't know about Sprint, but my old Cingular/AT&T contract specifically said in the fine print that when the contract period ran out, service automatically converted to month-to-month until I cancelled it. They may not have done anything wrong.  Hopefully, though, given the length of time and under these circumstances they'll work with you.  Good luck!

What I would do would depend on how much they were asking me to pay back.  If it was less than $250 and I had plans to buy a house, car, etc. soon, then I would probably just pay it.  If it was a lot more than that, then I would try to negotiate a lower payment amount (in writing) and/or consider asking the friend to help out.

Im curious, did the friend continue to use the phone on the month to month basis? If you told her it was supposed to expire.. and then she was able to keep using it, she should have let you know that something was going on. If she continued to use it then she probably should pay you something.

I'm also curious why the didn't inform you of your delinquent account when you went to get a new phone? That seems odd.
